Clyde & Co: Where others fear to tread

Clyde & Co. is a leading international law firm with over 2,350 staff based in 30 offices worldwide, and with in-depth knowledge in a wide range of sectors including energy, infrastructure, oil and gas, shipping/marine, aviation, insurance and international trade. Our broad network of offices means that our clients benefit from in-depth local expertise and know-how, with international law firm standards.

We represent clients across the entire spectrum of matters encountered in the upstream, midstream and downstream segments of the oil and gas industry. Our approach is to provide pragmatic and value-enhancing legal services, by providing a team with great depth and breadth of experience. This is supported by our experts in other fields which may be of relevance in each project, including, property, employment, insurance, marine/shipping, information technology and intellectual property. We advise at every phase of a project, from the pre-tender phase, through to project completion, and during its operation and maintenance. We are familiar with all of the main standard forms of contract (including FIDIC, ICE, NEC and JCT) and we prepare and advise on all forms of bespoke agreements.

Transactions that we have advised on include:

• Chad Cameroon Pipeline Project: advising the consortium (Exxon Mobil, Chevron and Petronas) on the multi –sourced financing of the 1070 pipeline and ancillary facilities for the export of crude oil from fields in the Doba basin in Chad.

• Prepared EPC contract documentation (based on FIDIC 1999 Edition) for process plant and new storage tank farm at a refinery in the Northern Emirates and for the construction and operation of an oil and gas pipeline.

• Successfully representing the government of Yemen in a multi-billion dollar high-profile dispute, in relation to a 20-year-old Production sharing agreement concerning the Marib Block 18 oil field. This was the largest ICC arbitration and second largest energy contract dispute of its time.

• Involved in the KBC v. Petramina case relating to the termination of an energy project.

• Drafting Interconnector Gas shipping agreements for the offtake of natural gas at Zeebrugge, and gas trading contracts in relation to the supply of gas on NBP and ZBT terms.

• Advising an international energy trader on a significant investment in private importation, storage, distribution and resale facilities for petroleum products in a Mediterranean country.
